Salary Advance to Employees: Policy and Recovery Rules
How to give and recover a salary advance in India: a written policy, recovery in instalments, the 50% cap on deductions, the payslip entry and exit.
Short answer: a salary advance is part of future wages paid early, recovered from later salaries. The Code on Wages, 2019 allows recovering advances from wages, but all deductions in a wage period together cannot exceed 50% of wages. Put the advance in writing with the instalments agreed, show each recovery on the payslip, and settle any balance in the full and final settlement if the person leaves.
KEY TAKEAWAYS
- Agree the amount, instalments and start month in writing before paying.
- Recover in instalments the employee can live on; total deductions cannot exceed 50% of wages.
- Show each recovery and the remaining balance on the payslip.
- Keep one register of open advances so none is forgotten at exit.
Why a written policy matters
Most small firms give advances informally: a request on WhatsApp, a bank transfer, and a note someone means to remember. Three months later nobody agrees on the balance. A one-page policy fixes that and makes advances fair across the team.
A policy you can copy
- Who: confirmed employees who have completed probation.
- How much: up to one month's net salary, one advance open at a time.
- Recovery: in equal monthly instalments over up to six months, starting the month after payment.
- Approval: the reporting manager and the owner or finance head, by email.
- Record: the employee signs or emails an acknowledgement stating the amount, instalments and start month.
- Exit: any balance is recovered from the full and final settlement.
A worked example
Sunil earns ₹40,000 gross and takes a ₹30,000 advance in October, to be recovered at ₹5,000 a month from November to April.
| Month | Recovery | Balance after |
|---|---|---|
| November | ₹5,000 | ₹25,000 |
| December | ₹5,000 | ₹20,000 |
| January | ₹5,000 | ₹15,000 |
| February | ₹5,000 | ₹10,000 |
| March | ₹5,000 | ₹5,000 |
| April | ₹5,000 | Nil |
Check the 50% limit every month. If Sunil's other deductions (PF, professional tax, TDS and so on) are ₹6,000, his total deductions in November are ₹11,000, well inside 50% of ₹40,000 (₹20,000). If he has a month with heavy unpaid leave, his wages fall and the cap falls with them; postpone that month's instalment rather than breach it.
Advance or loan?
A short advance against salary is different from a loan with interest and a long repayment period. Larger, longer or interest-free loans to employees can have tax consequences for the employee. If you lend more than a month's salary or for longer than a year, ask your CA how to treat it.
On the payslip and at exit
Show the recovery as its own deduction line, "Salary advance recovery: ₹5,000 (balance ₹20,000)", rather than burying it in "other deductions". The employee can check it, and so can you. If the employee leaves with a balance, recover it from the full and final settlement, and keep the signed acknowledgement on file in case the amount is disputed.
How Grovia handles it
Each Grovia payslip has an "other deductions" amount and a notes field, where HR enters the month's recovery and the remaining balance. Grovia does not keep a separate advance ledger or schedule instalments automatically, so keep your register of open advances alongside it and enter the instalment each month before the payslip is final.
Grovia runs employees and payroll alongside leads, quotations, GST invoices, payments and your team in one place. Start a free 14-day trial (no card needed).

Frequently Asked Questions
Can an employer deduct a salary advance from wages?
Yes. Recovery of advances is a permitted deduction under the Code on Wages, 2019, within the overall limit that total deductions in a wage period cannot exceed 50% of wages.
How much salary advance can an employee get?
The law sets no amount; it is the employer's policy. One month's net salary, recovered over up to six months, is a common choice for small firms.
What happens to a salary advance if the employee resigns?
The remaining balance is recovered from the full and final settlement, which is why the employee's written acknowledgement of the advance matters.
Should a salary advance be shown on the payslip?
Yes. Show the recovery as a separate deduction with the remaining balance, so the employee can check it each month.
Is a salary advance taxable?
A short advance against salary is generally just salary paid early. Larger or longer interest-free loans to employees can be treated differently for tax, so check with your CA.
